DECREE OF THE MINISTER OF TRADE

CONCERNING
PROVISIONS ON THE EXPORT OF TEXTILES AND TEXTILE PRODUCTS (TPT)

THE MINISTER OF TRADE,

Considering:

a. that pursuant to the Agreement on Textile and Clothing (ATC) of the World Trade Organization (WTO), the export quota of Textile and Textile Products (TPT) ends on December 31, 2004 and the international TPT trade follows WTO general provisions as from January 1, 2005;
b. that in the framework of enhancing, developing and guaranteeing business certainty in the TPT sector, provisions on the export of TPT need to be stipulated;
c. that in relation to the matters in letters a and b, a decree of the Minister of Trade needs to be stipulated;

In view of:

1. The Trade Ordinance of 1934 (Statute Book of 1938 No. 86);
2. Law No. 7/1994 on ratification of the Agreement Establishing the World Trade Organization (Statute Book of 1994 No. 57, Supplement to Statute Book No. 3564);
3. Law No. 10/1995 on customs affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
4. Presidential Decree No. 260/1967 on affirmation of tasks and responsibility of the Minister of Trade in the international trade sector;
5. Presidential Decree No. 102/2001 on the status, tasks, functions, authority, organizational structures and working arrangements of ministries;
6. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;
7. Presidential Decree No. 187/M/2004 on the establishment of the United Indonesia Cabinet;
8. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 on export general provisions as already amended several times and the latest by Decree of the Minister of Industry and Trade No. 385/MPP/Kep/6/2004;
9. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;
10. Decree of the Minister of Industry and Trade No. 618/MPP/Kep/10/2004 on certificate of origin of Indonesian exported goods;

DECIDES:

To revoke:

1. Decree of the Minister of Industry and Trade No. 53/MPP/Kep/2/200 on taking over of textile and textile product quota;

2. Decree of the Minister of Industry and Trade No. 311/MPP/Kep/10/2001 on provisions on the export quota of textile and textile products.

To stipulate:

THE DECREE OF THE MINISTER OF TRADE ON PROVISIONS ON THE EXPORT OF TEXTILE AND TEXTILE PRODUCTS

Article 1

Referred to in this decree as:

1. Textile and Textile Products (TPT) shall be fibers, yarns, textile sheets, clothing and other finished goods made of textile subsumed into the Indonesian Import Duty Tariff Book with heading no. HS 5001 up to 6310, Ex 6405, EX 6501, EX 6502, EX 6503, EX 6504, EX 6505, EX 7019 and EX 9404.
2. Certificate of Origin, hereinafter abbreviated to SKA shall be a document based on bilateral, regional, multilateral agreement or unilateral provision of a certain country or because of stipulation by the Indonesian government, which must be accompanied when Indonesian exported goods will enter the territory of certain countries proving that the goods come from, are produced and/or processed in Indonesia as regulated in Decree of the Minister of Industry and Trade No. 618/MPP/Kep/10/2004.
3. Master Bill of Lading (Master B/L) or Airway Bill (AWB) shall a transport document of goods issued by shipping companies/airlines.

Article 2

The export of TPT to the United States, Canada, European Union and Turkey shall be accompanied by SKA.

Article 3

The issuance of every SKA by institution issuing SKA in the framework of the export of TPT as meant in Article 2 shall be accompany by original copy of Master B/L or copy of AWB as well as other required documents in accordance with the provisions in force.

Article 4

With the issuance of this decree, the following provisions shall apply:

a. in the case of the Issuance of SKA in the framework of the export of TPT realized on January 1 - 12E005, the provisions as regulated in Decree of the Minister of Industry and Trade No. 111/MPP/Kep/2/2002 on certificate of origin of Indonesian exported goods apply;
b. the provisions on the issuance of SKA in the framework of the export of TPT as regulated in Article 12 paragraph (2) of Decree of the Minister of Industry and Trade NO. 618/MPP/Kep/10/2004 are declared null and void;
c. Figure I point 3 of the attachment to Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 on general provisions in the export field as already amended several times and the latest by Decree of the Minister of Industry and Trade No. 385/MPP/Kep/6/2004 is declared null and void;
d. All technical directives for Decree of the Minister of Industry and Trade No. 311/MPP/Kep/10/2001 are declared null and void.

Article 5

This decree shall come into force as from January 1, 2005.

For public cognizance, this decree shall be announced by placing it in State Gazette of the Republic of Indonesia.
